The current Department of Justice is choosing to continue enforcing an unconstitutional legal theory<\/strong>\u00a0being weaponized against gun owners by the Bureau of Alcohol, Tobacco, Firearms and Explosives.<\/p>\n According to a recent statement in GOA\u2019s\u00a0Texas et al. v. ATF<\/em>\u00a0case,\u00a0DOJ claims that ATF\u00a0<\/strong>\u201ccontinue[s] to enforce the NFA\u2019s and the GCA\u2019s regulation of short-barreled rifles against some brace-equipped pistols,\u00a0<\/strong>even though\u00a0the Rule has been universally vacated<\/strong>.\u201d<\/em><\/p>\n For those who are unfamiliar,\u00a0in 2022 the Biden Administration issued an executive order<\/strong>\u00a0instructing the Department of Justice to ban\u00a0pistol braces,<\/strong>\u00a0a popular firearm accessory designed to allow shooters with disabilities to \u201cbrace\u201d their firearms against their forearm.<\/p>\n The Biden DOJ used this rule to effectively outlaw firearms equipped with stabilizing braces,<\/strong>\u00a0by regulating them as short-barreled firearms under the National Firearms Act.\u00a0This move turned the law-abiding owners of upwards of 40 million pistol braces \u00a0into felons practically overnight, unless they destroyed their firearm or registered it with the federal government.<\/a><\/p>\n GOA and other pro-gun groups challenged this pistol brace rule in multiple courts across the country, culminating with a total elimination of the rule in court.<\/p>\n
