Her filing comes amid renewed scrutiny surrounding the pending release of Epstein-related documents.<\/p>\n
The petition references four alleged \u201cco-conspirators\u201d and 25\u00a0additional\u00a0men who were never indicted despite, according to Maxwell, being similarly implicated in the crimes.\u00a0<\/strong><\/p>\nShe said the government\u2019s\u00a0purported failure\u00a0to\u00a0charge\u00a0those individuals showed she was selectively prosecuted.<\/p>\n
In the filing, Maxwell acknowledged that a defendant moving to dismiss for selective prosecution \u201cbears the heavy burden of establishing\u201d that others similarly situated were not prosecuted for the same conduct while she was singled out, and that the government\u2019s decision was discriminatory or made in bad faith.<\/p>\n
\u201cNone of the 4 named co-conspirators or the 25 men with secret settlements were indicted,\u201d<\/strong><\/em>\u00a0Maxwell wrote.<\/p>\nMaxwell claimed the existence of the 25 men\u00a0emerged\u00a0through government disclosures and civil litigation materials that were never provided to her defense.<\/p>\n
\u201cNew evidence reveals that there were 25 men with which the plaintiff lawyers reached secret settlements \u2013 that could equally be considered as coconspirators,\u201d<\/strong><\/em>\u00a0she added. \u201cNone of these men have been prosecuted and none has been revealed to Petitioner; she would have called them as witnesses had she known.\u201d<\/p>\nMaxwell further alleged that her\u00a0indictment\u00a0followed Epstein\u2019s 2019 death in federal custody and was driven by political expediency.<\/p>\n
\u201cNew evidence reveals the reason why the Petitioner was indicted after having not been named and included in any of the earlier criminal indictments against Epstein or the Palm Beach Police Investigation,\u00a0simply put it was for expediency and purely political motives<\/strong>\u00a0following the death of Jeffrey Epstein in the care custody and control of the US Government,\u201d she claimed.<\/p>\n____
