RE: Your Willful Refusal to Vacate Unlawful Stay in Violation of NRS 177.015(2) \u2013 Formal Notice of Civil Action Pending<\/b><\/p>\n

Ms. Rinetti,<\/p>\n

This letter serves as final formal notice<\/b> of my intent to initiate a civil lawsuit against you in your personal and official capacity<\/b> arising from your willful refusal<\/b> to move to vacate an unlawful stay of proceedings<\/b> entered in Case No. C-19-343540-1&2<\/b>, a stay which you improperly requested, and which was granted without lawful basis on September 24, 2025<\/b>.<\/p>\n

As stated in my prior letter dated October 10, 2025<\/b>, you were placed on clear legal notice<\/b> that:<\/p>\n

    \n
  1. Your oral request for a stay at the conclusion of the September 5, 2025<\/b> evidentiary hearing was made without any statutory authority under NRS 177.015(2)<\/b>;<\/li>\n
  2. You never filed the required notice of appeal<\/b> in either the District Court or the Nevada Supreme Court within the strict statutory deadlines, 2 judicial days and 5 judicial days, respectively;<\/li>\n
  3. Even the most generous interpretation of any potentially applicable timeline (i.e., 30 days) expired October 6, 2025<\/b>; and<\/li>\n
  4. The Court\u2019s September 24 order, which granted your stay request, is procedurally void<\/b> and legally unsupportable<\/b> under controlling Nevada law (State v. Braidy<\/i>, State v. Loyle<\/i>).<\/li>\n<\/ol>\n

    Despite receiving that formal demand and being given 72 hours<\/b> to take corrective action, you chose to do nothing<\/b>. You did not file<\/b> an emergency motion to vacate the unlawful stay, nor did you provide any legal basis for the continued suspension of proceedings. Your silence is not neglect, it is a willful, knowing, and malicious refusal<\/b> to mitigate damage and comply with clearly established law.<\/p>\n

    This conduct satisfies the elements of the following civil causes of action, which I fully intend to pursue:<\/p>\n

    • Abuse of Process<\/b><\/li>\n
    • Malicious Prosecution<\/b><\/li>\n
    • Deprivation of Constitutional Rights Under Color of Law<\/b> (42 U.S.C. \u00a7 1983)<\/li>\n
    • Intentional Infliction of Emotional Distress<\/b><\/li>\n
    • Negligent Supervision and Retention<\/b> (against your office, as applicable)<\/li>\n<\/ul>\n

      These claims shall be pursued in Federal Court, and will name you personally<\/b> as a defendant. As you should be aware, qualified immunity does not apply<\/b> to prosecutors acting outside the scope of their lawful authority, and it is well-established that fraud and bad faith vitiate immunity in both individual and official capacities<\/b>.<\/p>\n

      Accordingly, I hereby demand that you:<\/p>\n

        \n
      1. Immediately file a motion on an order shortening time<\/b> to vacate the unlawful September 24 stay;<\/li>\n
      2. Immediately restore the case to active trial status;<\/li>\n
      3. Preserve all communications, records, emails, case notes, and internal correspondence relevant to this matter, including your decision not to act after October 10, 2025.<\/li>\n<\/ol>\n

        Failure to comply will result in immediate legal action without further notice.<\/p>\n

        Your inaction has caused prolonged harm, violated my right to due process, and continues to prejudice both myself and my wife. This is not a procedural oversight, it is prosecutorial misconduct<\/b> in plain sight.<\/p>\n

        You are now on final legal notice. The record of your willful misconduct will follow you into every courtroom, bar complaint, and oversight investigation this case demands.<\/p>\n

        You will be sued. You will be held accountable.<\/b><\/p>\n
