See: <strong><a href=\"https:\/\/stateofthenation.info\/?p=6940\">JOE BIDEN WAS DISQUALIFIED FROM RUNNING FOR POTUS<\/a><\/strong><\/h3>\n<hr \/>\n<h3 style=\"padding-left: 40px;\"><strong>KEY POINT:<\/strong> This is not the first time that Biden has tried to pull off these presidential pardon crime cover-ups. See: <strong><a href=\"https:\/\/stateofthenation.info\/?p=7014\">HUNTER\u2019S PARDON: Corrupt &amp; Criminal, Lawless &amp; Illicit, Brazen &amp; Reckless, Illegal &amp; Unlawful<\/a><\/strong><\/h3>\n<hr \/>\n<h2>Conclusion<\/h2>\n<h3>There&#8217;s a very good reasons why Biden is strictly prohibited from issuing these pre-emptive pardons.<\/h3>\n<h3>A POTUS cannot pardon any individual for a crime unless it has been properly adjudicated and a conviction(s) has been won.<\/h3>\n<h3>Which leads us to the most dubious aspect of Biden&#8217;s corrupt pardon history: <strong><em>Why is he pardoning people unless he knows they all have committed some pretty serious crimes?\u00a0 <\/em><\/strong>For Biden, that would make it &#8220;misprision of felony&#8221;.<\/h3>\n<hr \/>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-13104\" src=\"https:\/\/stateofthenation.info\/wp-content\/uploads\/2025\/01\/Screen-Shot-2025-01-20-at-11.10.32-AM.png\" alt=\"\" width=\"440\" height=\"202\" srcset=\"https:\/\/stateofthenation.info\/wp-content\/uploads\/2025\/01\/Screen-Shot-2025-01-20-at-11.10.32-AM.png 440w, https:\/\/stateofthenation.info\/wp-content\/uploads\/2025\/01\/Screen-Shot-2025-01-20-at-11.10.32-AM-300x138.png 300w\" sizes=\"auto, (max-width: 440px) 100vw, 440px\" \/><\/p>\n<hr \/>\n<h3>In which case he should be making criminal referrals to his Attorney General for immediate investigation and prosecution.\u00a0 That means his primary purpose is to cover up the covert criminal activity of which he himself may be a co-conspirator.\u00a0 However, not even a POTUS can commit crimes with impunity; and they should be impeached for their &#8220;high crimes and misdemeanors&#8221; by the House and face final justice in the U.S. Senate.<\/h3>\n<h1 style=\"text-align: center;\">~~~ CASE CLOSED ~~~<\/h1>\n<h3>Update #1<\/h3>\n<h3><a href=\"https:\/\/stateofthenation.info\/?p=13121\"><strong>Incorrigibly corrupt Biden illicitly pardons several close family members in a final act of criminal cover-up<\/strong><\/a><\/h3>\n<h3><a href=\"https:\/\/stateofthenation.info\/?p=13086\">State of the Nation<\/a><br \/>\nJanuary 20, 2025<\/h3>\n<h3>N.B. What follows is an insightful commentary that obliquely corroborates the preceding analysis.<\/h3>\n<hr \/>\n<h2>There\u2019s a good argument that Biden\u2019s mass pardons are unconstitutional<\/h2>\n<p>By Andrea Widburg<br \/>\nAmerican Thinker<\/p>\n<p>I\u2019ve been mulling President Biden\u2019s mass pardons, whether the \u201cdeath penalty\u201d commutations in December or the drug offense pardons now. I think they\u2019re unconstitutional. If I\u2019m right, they have no legal meaning and are theoretically unenforceable. And while that probably won\u2019t matter with the almost 2,500 drug offenders, it should matter with the people on death row.<\/p>\n<p>When Biden issued his death penalty commutations, he was clear that he did so because he\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/12\/23\/fact-sheet-president-biden-commutes-the-sentences-of-37-individuals-on-death-row\/\">disagrees with the law<\/a>:<\/p>\n<blockquote><p>He believes that America must stop the use of the death penalty at the federal level, except in cases of terrorism and hate-motivated mass murder \u2013 which is why today\u2019s actions apply to all but those cases.<\/p><\/blockquote>\n<p>Biden had the same disagreement with\u00a0<a href=\"https:\/\/www.marinij.com\/2025\/01\/17\/biden-record-commuting-2500-people\/\">the latest round of pardons<\/a>:<\/p>\n<blockquote><p>The Democrat said he is seeking to undo \u201cdisproportionately long sentences compared to the sentences they would receive today under current law, policy, and practice.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cToday\u2019s clemency action provides relief for individuals who received lengthy sentences based on discredited distinctions between crack and powder cocaine, as well as outdated sentencing enhancements for drug crimes,\u201d Biden said in a statement.<\/p><\/blockquote>\n<p>The above ignores that Congress could have addressed these concerns when it passed new drug legislation&#8230;but did not do so.<\/p>\n<p>Given Biden\u2019s motives\u2014not that the law was wrongly applied (as J6 supporters argue) but that he just doesn\u2019t like the law\u2014it\u2019s worth asking what the constitutional consequences are.<\/p>\n<p>The Constitution has three clearly delineated branches of government: Executive, Legislative, and Judiciary. Technically, the Executive cannot legislate or pass judgment, the Legislature cannot take on administrative duties or decide cases, and the Judiciary cannot manage the government or legislate.<\/p>\n<p>In the spirit of checks and balances, though, no one branch of the government has absolute power. However, while the Judiciary and Executive routinely exceed the written checks and balances to intrude on Legislative prerogatives\u2014with the judiciary enacting and rewriting laws from the bench and the presidency doing the same through agencies that make rules with the force of law\u2014Congress has lazily acceded to these power grabs, effectively giving up powers it has no authority to give away.<\/p>\n<p>Congress\u2019s unconstitutional passivity is ironic, given that the Founders intended for the Legislature to be the most powerful branch of government. That\u2019s because it is the branch most closely connected to the will and voice of the people (via the House\u2019s two-year, tightly local elections). Thus, under the Constitution, the legislature has significant control over both the White House and the judiciary.<\/p>\n<p>But what about the president\u2019s pardon power? Isn\u2019t that unlimited? No.<\/p>\n<p>At the Constitutional Convention, there was serious debate about the pardon power, which had\u00a0<a href=\"https:\/\/www.whitehousehistory.org\/the-history-of-the-pardon-power\" target=\"_blank\" rel=\"noopener\">long been a prerogative of the king<\/a>\u00a0under British common law. Beginning in the 7th century, the pardon has been viewed as a form of last resort\u00a0<a href=\"https:\/\/csac.history.wisc.edu\/2021\/01\/04\/pardons-and-reprieves\/\" target=\"_blank\" rel=\"noopener\">when justice has gone awry<\/a>:<\/p>\n<blockquote><p>The king of England and colonial American governors could grant pardons and reprieves. According to Sir William Blackstone\u2019s Commentaries on the Law (1765-1769), pardons were intended to assure justice in cases where the courts (judges and\/or juries) rendered decisions that resulted in the miscarriage of justice.<\/p><\/blockquote>\n<p>For hundreds of years, kings interceded when they felt that an individual was treated unfairly or, in the case of rebellions, when they believed that mercy was the only way to stitch the nation back together.<\/p>\n<p>Unsurprisingly, given that the Americans had just completed a rebellion, that last point\u00a0<a href=\"https:\/\/www.history.com\/news\/how-american-presidents-ended-up-with-the-kingly-power-to-pardon-2\">was the primary reason<\/a>\u00a0Alexander Hamilton was so committed to bringing the pardon power to the presidency.<\/p>\n<p>In sum, historical British usage (which is\u00a0<a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?referer=&amp;httpsredir=1&amp;article=3029&amp;context=penn_law_review\">folded into American law<\/a>) and the Constitutional Convention itself establish two circumstances for presidential pardons: Mercy when the law has been cruelly applied to an individual and healing when the nation is wounded. Those are appropriate constitutional uses. Even when Biden pardoned Hunter, he stayed within that first line, saying he felt the operation of law had been unfair to his son.<\/p>\n<p>But now it\u2019s time to go back to the White House statements about Biden\u2019s mass pardons and commutations. \u00a0In both cases, Biden is not saying that the law was too harshly applied to individuals or that the nation\u2019s wounds need binding. Instead, he has proudly announced that he doesn\u2019t like the applicable laws and is unilaterally rewriting them.<\/p>\n<p>That is a purely legislative act that is entirely outside the president\u2019s constitutional purview, including the broad pardon power. Biden can say he\u2019s issued the commutations and pardons, but he actually hasn\u2019t. Trump would be well within his authority to reinstate the death penalty sentences, although I suspect the drug pardons will get a pass.
